THE SANOFA TRIBE’S NOTICE OF PRIVACY PRACTICES

THE INFORMATION BELOW WILL INCLUDE INFORMATION ON HOW ALL INFORMATION ABOUT YOU MAY BE USED & DISCLOSED, AND HOW YOU CAN OBTAIN THE INFORMATION WHEN NEEDED. PLEASE REVIEW CAREFULLY AS YOU WILL BE ASKED TO SIGN A CONFIRMATION STATING THAT YOU HAVE READ AND UNDERSTAND THE POLICIES.

I. This Notice describes the privacy practices of The Sankofa Tribe, coaches, administrative/office personnel, and other personnel. It applies to services furnished to you at the office of The Sankofa Tribe as well via any tele/online communications applications (i.e. video chat, text messaging, and/or email).

II. Our Privacy Obligations - We are required by law to maintain the privacy of your health (& personal) information ("Protected Health Information" or "PHI") and to provide you with this Notice of our legal duties and privacy practices with respect to your Protected Health Information. When we use or disclose your Protected Health Information, we are required to abide by the terms of this Notice (or other notice in effect at the time of the use or disclosure).

III. Permissible Uses and Disclosures without Your Written Authorization in certain situations (which will be described below) - We must obtain your authorization and written consent in order to use and/or disclose your PHI. However, unless the PHI is Highly Confidential Information (as defined in Section PLC below) and the applicable law regulating such information imposes special restrictions on us, we may use and disclose your PHI without Your Authorization for the following purposes:

A. Treatment, Payment, and Health Care Operations - We may use and disclose PHI, in order to treat you, obtain payment for services provided to you, and conduct our health care operations as detailed below.

The Sankofa Tribe’s policies and procedures require that we obtain your written consent/authorization in order to disclose most PHI:​

Treatment - We use and disclose your PHI to provide treatment and other services to you. In addition, we may contact you to provide appointment reminders or information about treatment alternatives or other health-related benefits and services that may be of interest to you. We may also disclose PHI to other providers involved in your care. Although possible under serious circumstances, The Sankofa Tribe will do all we can to obtain your authorization and written consent prior to sharing your PHI.

Payment - We may use and disclose your PHI to obtain payment for services that we provide to you.

Health Care Operations - We may use and disclose your PHI for our health care operations, which include internal administration and planning and various activities that improve the quality and cost-effectiveness of the care that we provide to you. For example, we may use PHI to evaluate the quality and competence of our coaches. We may disclose PHI to our Patient Relations Coordinator in order to resolve any complaints you may have and ensure that you receive comfortable and quality service.

B. Disclosure to Relatives Close Friends and Other Caregivers - We may use or disclose your PHI to a family member, other relatives, a close personal friend, or any other person identified by you when you are present for, or otherwise available prior to, the disclosure, if we (1) obtain your agreement; (2) provide you with the opportunity to object to the disclosure and you do not object; (3) reasonably infer that you do not object to the disclosure. If you are not present, or the opportunity to agree or object to a use or disclosure cannot practicably be provided because of your incapacity or an emergency circumstance, we may exercise our professional judgment to determine whether a disclosure is in your best interests. If we disclose information to a family member, other relatives, or a close personal friend, we would disclose only information that we believe is necessary and directly relevant to the person's involvement with your health care or payment related to your health care. We may also disclose your PHI in order to notify (or assist in notifying) such persons of your location, general condition, or death.

C. Public Health Activities - We may disclose your PHI for the following public health activities, (1) to report health information to public health authorities for the purpose of preventing or controlling disease, injury or disability; (2) to report child abuse and neglect to necessary authorities authorized by law to receive such reports; (3) to report information about products and services under the jurisdiction of the U.S. Food and Drug Administration; (4) to alert a person who may have been exposed to a communicable disease or may otherwise be at risk of contracting or spreading a disease or condition; and (5) to report information to your employer as required under laws addressing work-related illnesses and injuries or workplace medical surveillance.

D. Victims of Abuse Neglect or Domestic Violence - If we reasonably believe you are a victim of abuse, neglect, or domestic violence, we may disclose your PHI to necessary authorities, including social service or protective services agency, authorized by law to receive reports of such abuse, neglect, or domestic violence.

E. Health Oversight Activities - We may disclose your PHI to a health oversight agency that oversees the health care system and is charged with responsibility for ensuring compliance with the rules of government health programs.

F. Judicial and Administrative Proceedings - We may disclose your PHI in the course of a judicial or administrative proceeding in response to a legal order or other lawful process. Further, unless specifically authorized by a court order, we may not use or disclose PHI identifying you as a recipient of substance abuse program services if the purpose is to initiate or substantiate any criminal charges against you or to conduct any investigation of you.

G. Law Enforcement Officials - We may disclose your PHI to the police or other law enforcement officials as required or permitted by law or in compliance with a court order or a grand jury or administrative subpoena.

H. Decedents - We may disclose your PHI to a coroner or medical examiner as authorized by law.

I. Organ and Tissue Procurement - We may disclose your PHI to organizations that facilitate organ, eye, or tissue procurement, banking, or transplantation.

J. Health or Safety - We may use or disclose your PHI to prevent or lessen a serious and imminent threat to a person's or the public's health or safety.

K. Specialized Government Functions - We may use and disclose your PHI to units of the government with special functions, such as the U.S. military or the U.S. Department of State under certain circumstances.

L. Workers Compensation - We may disclose your PHI as authorized by and to the extent necessary to comply with state law relating to workers' compensation or other similar programs.

M. As Required by Law - We may use and disclose your PHI when required to do so by any other law not already referred to in the preceding categories.

IV. Uses and Disclosures Requiring Your Written Authorization - For any purpose other than the ones described above, we only may use or disclose your PHI when you give us your authorization in writing or by signing one of our authorization forms.

Uses and Disclosures of Your Highly Confidential Information - In addition, federal and state law imposes special privacy protections for "Highly Confidential Information", which is Psychotherapy/Coaching Notes and the subset of Protected Health Information that is related to, (1) treatment of a mental illness; (2) alcohol and drug abuse treatment program services; (3) HIV/AIDS testing; (4) child abuse and neglect (5) sexual assault; and (6) genetic testing. In order for us to disclose your Highly Confidential Information for a purpose other than those permitted by laws regulating Highly Confidential Information, we must obtain your authorization.

V. Your Rights Regarding Your Protected Health Information

A. For Further Information Complaints - If you desire further information about your privacy rights, are concerned that we have violated your privacy rights, or disagree with a decision that we made about access to your PHI, you may contact our Administrative Office. Upon request, the Administrative Office will provide you with the correct address for the Director. We will not retaliate against you if you file a complaint with us.

B. Right to Request Additional Restrictions - You may request restrictions on our use and disclosure of your PHI, (1) for treatment, payment, and health care operations; (2) to individuals (such as a family member, other relatives, close personal friend or any other person identified by you) involved with your care or with payment related to your care; or (3) to notify or assist in the notification of such individuals regarding your location and general condition. While we will consider all requests for additional restrictions carefully, we are not required to agree to a requested restriction. If you wish to request additional restrictions, please obtain a request form by contacting our Administrative Office; upon receipt complete and submit the completed form to the address below or email it to getintouch@thesankofatribe.com. We will send you a written response.

C. Right to Receive Confidential Communications - You may request in writing, and we will accommodate any reasonable written request for you to receive your PHI by alternative means of communication or at alternative locations.

D. Right to Revoke Your Authorization - You may revoke your authorization, except to the extent that we have taken action in reliance upon it, by delivering a written revocation statement to the Administrative Office. A form of Written Revocation is available upon request from the Privacy Office.

E. Right to Inspect and Copy Your Health Information - You may request access to your health records and billing records maintained by us in order to inspect and request copies of the records. Under limited circumstances, we may deny you access to a portion of your records. If you desire access to your records, please obtain a record request form from the Administrative Office and submit the completed form to the address below or email it to getintouch@thesankofatribe.com. If information needs to be mailed, we will charge you for the postage costs.

F. Right to Amend Your Records - You have the right to request that we amend Protected Health Information maintained in your medical record file or billing records. If you desire to amend your records, please obtain an amendment request form from the Administrative Office and submit the completed form to the address below or email it to getintouch@thesankofatribe.com. We will comply with your request unless we believe that the information that would be amended is accurate and complete or other special circumstances apply.

G. Right to Receive an Accounting of Disclosures - Upon request, you may obtain an accounting of certain disclosures of your PHI made by us during any period of time prior to the date of your request provided such period does not exceed five years.

H. Right to Receive Paper Copy of this Notice - Upon request, you may obtain a paper copy of this Notice, even if you have agreed to receive such notice electronically.

VI. Effective Date and Duration of This Notice

A. Effective Date - This Notice is effective on 8/15/2018.

B. Right to Change Terms of this Notice - We may change the terms of this Notice at any time. If we change this Notice, we may make the new notice terms effective for all Protected Health Information that we maintain, including any information created or received prior to issuing the new notice. If we change this Notice, we will post the new notice on our website. You also may obtain any new notice by contacting the Administrative Office.

THE SANKOFA TRIBE POLICIES​

By accessing our site, you agree that you have read and understand The Sankofa Tribe’s Privacy Policy which describes how we use your personal information, and what options you have to update or request the deletion of information submitted to us.

Information We Collect

The Sankofa Tribe may collect both Usage Data and Personally Identifiable Information via this site. Usage Data is information that describes the habits and other behavioral traits of the users of the site as a group but does not indicate the identity of a particular user. The Sankofa Tribe tracks the number of users accessing the site via a counter that monitors the IP addresses of our visitors. The Sankofa Tribe does not retain Usage Data and uses it only to track the number of unique visitors to our site.

The Sankofa Tribe does not wish to collect Personal Information from minors (children under 17 years of age, or any other age defined under applicable law). Information removed from our mailing lists will not be retained by The Sankofa Tribe.

Sales -

Orders Any purchases made on The Sankofa Tribe website will require certain personal identifiable information from the purchaser. This information will include name, address, contact information, and financial information which thesankofatribe.com will use to complete the shopper’s purchase.

The information collected will be used to pay for the full amount of the shopper’s purchase, including the cost of item/s and the shipping costs; the information will also be used to mail item/s purchased to the shopper’s requested destination. If there is an issue with the payment during the processing of a Sankofa Tribe item, a Representative will contact the shopper using the information that was provided by the shopper. The shopper’s email will be used to contact the shopper regarding their order confirmations and other information pertaining to their order.

Payment Processing

The Sankofa Tribe uses a third party to provide payment processing services on our site. All credit card transactions processed through the thesankofatribe.com website are done so securely, kept in strict confidentiality, and will not be released to any other party at any given time.

Shipping -

Orders processed through thesankofatribe.com will be shipped within 1 to 10 business days after payment has been processed unless otherwise specified. This excludes Saturdays, Sundays, and holidays.

Orders may be sent to more than one address. Each order is considered a separate order and will be individually charged the appropriate shipping fees. We currently ship via USPS. USPS delivers packages 6 days a week, excluding Sundays and holidays. Once your entire order is processed, you will receive shipping confirmation via email with the USPS tracking information.

Delivery times are estimated. Actual delivery times may vary depending on shipping locations. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Once your order has been processed, you can track your order by either contacting USPS at 800.222.1811 during the hours of 8 AM - 8:30 PM ET Monday through Friday, and 8 AM - 6 PM ET on Saturdays; USPS is closed on Sundays and holidays. Anyone placing an order on thesankofatribe.com must be at least 16 years of age. Any information received on this website signifies to us that the individual is at least 16 years of age or has received the permission of their parent/guardian.

Cancellations, Returns & Exchanges -

Cancellations or changes to an order must be made within 24 hours after the order has been placed. Please note that cancellations or changes are not guaranteed due to the possibility of the order already being processed. Several types of goods are exempt from being returned. They include a) gift cards & b) downloadable software products.

Full price returns:

The full amount of your purchase will be credited to the original form of payment (credit or debit card, gift card, or online gift certificate) if returned within 14 days of the shipping date that appears on your invoice. If a return is postmarked within the 14 days, then you will receive a full refund. Each item returned must have the original invoice included in the returned package, and the original tags must be on the item/s. Please note that any items postmarked after the 14 days but within 21 days of the shipping date are eligible for store/online credit only. No returns will be accepted after 21 days of the shipping date shown on the invoice. The amount of credit will be the amount paid for the item/s at the time of purchase excluding taxes and the shipping costs. You will not receive credit for any item/s that appears to have been worn or destroyed. You will receive an email confirmation after the credit from the return has been processed. Please allow 10-14 business days for us to receive and process your return.

Any apparel that has been tailored or personalized is not eligible for refund or exchange.

Making a return:

As long as the item/s being returned is within 21 days of the shipping date, please contact The Sankofa Tribe for a return label via email at getintouch@thesankofatribe.com or by calling 844.222.8500; for clarification on returns and refunds please refer to the terms above. We will provide you with a postage-paid return label via email or postal mail. For your convenience, please use the original shipping box and packing materials. Place the label onto the package and mail or drop the package off at your nearest USPS location. If the item/s are returned due to damage prior to original delivery, then The Sankofa Tribe will be responsible for shipping fees. If the items are returned due to any other reason the customer will be responsible for the shipping fees which will be deducted from the credit amount. Please allow 10-14 business days for us to receive and process your return.

Making an exchange:

As long as the item/s being returned is within 21 days of the shipping date, please contact The Sankofa Tribe for a return label via email at getintouch@thesankofatribe.com or by calling 844.222.8500. We will provide you with a postage-paid return label via email or postal mail. For your convenience, please use the original shipping box and packing materials. Exchange requests for items must be made within 14 days from the shipping date that appears on your invoice. Please specify the exchange item and the new color, size, or item change on the return/exchange form and include the form in the return package. Place the label onto the package and mail or drop the package off at your nearest USPS location. If the exchange is due to a mistake on the part of The Sankofa Tribe we will pay the shipping costs to send a replacement item and will send the item by ground delivery. If the exchange is due to a mistake on the part of the customer, then the customer will be responsible for shipping costs. Returned exchange items will be credited to the original form of payment and then a new order will be placed with the updated item/s. Availability of replacement items is not guaranteed. You will be notified by email upon the completion of the exchange process. Please allow 10-14 business days for us to receive and process the exchange.
